Can we apply for VA Aid and Attendance benefit if also applying for Medicaid using the so called Miller Trust also called Income Diversion Trust.


Also when I spoke with someone from city of ABQ senior affairs and asked for listing of facilities that accept Medicaid, the list she sent showed all long term care facilities. No distinction between those who do and didn't accept Medicaid. Does such a listing exist? Is seems hard to get correct information from government sources.

Generally, you cannot have both Aid and Attendance and Medicaid. Check with your state Medicaid office

why do you think you need both? Aid and attendance is income based, whoever needs it probablt doesn’t financially qualify if they have to use a miller trust in order to get Medicaid. If the person had already been receiving aid & attendance and had to go in to a nursing home, their aid and attendance would drop down to $90 a month.

If you are looking into Medicaid for LTC, then no you cannot have A and A too. Its been 3 yrs since I applied for A&A but the most a Vet could get was 1700, spouse 1200. This wouldn't even cover half of the cost of a NH which can be 10k a month private pay.

With Medicaid, you spend down any assets you have to the cap they allow, my state its 2k. Your SS and pension (if u have one) go to offset the cost of your care with Medicaid paying their share. A personal needs account will be set up and about $50 (depending on ur state) each month will be deposited in it. If income is higher than the Medicaid cap, a Miller trust could be set up.

I think most LTC facilities except Medicaid. You are just going to have to make calls to see which ones do. Then you are going to need to visit to see if they are nice ones.

I don't really think you can have the maximum of one or the other. It's double dipping on the federal teat. Think about it.

The rule I was told. If keeping at home VA A&A. if facility care, Medicaid.
