My question is: Is it HSA acceptable for me to bill her for services as a nurse so she can get reimbursement from her HSA? She is in independent living currently at a facility that offers multiple levels of care. Her campus charges $550 for medication management, $60 for showering, etc. Would it have any impact on her from a Medicare standpoint? Thanks for your reply. It's all so confusing!

Why can't she use it to offset the cost of services at the AL. You need to see if she has a booklet discribing how she can use this money. If not, call the company in charge of the acct.

Cheryl, to be certain you are not creating issues for medicaid in the future, see a certified elder law attorney (www.nelf.org) and get a care contract that abides by your state laws. Then follow their advice to keep things legal.

I'm confused as to how she still has an HSA if she's on Medicare... or is she? Usually your employer sets up the HSA (because I had one for my employees for many years). Are you referring to a Health Savings Account? Or something else?

More info would be helpful.

Just going thru this. You can have HSA on Medicare, just cannot contribute above a certain amount. It’s prorated by number of months not on Medicare divided by 12 times the annual allowable limit for HSA for person. Does not have to be used by end of year. Does have to be supported by receipts/EOB for payments and these can be audited. If you charge mom’s HSA, you had better declare it on taxes and the services fall within HSA guidelines. HSA comes under purview of IRS also…
