We are applying for VA benefits. If we sell mom's house will she be disqualified for VA benefits for assisited living care?

daughterlinda, Have you explained to your father that he is runing out of money. That the selling the car will allow him to continue with his current level of care?

You can sell it if she will agree to sign the papers. Even if you are POA, you must follow her wishes. If you have already submitted the VA forms, wait until you hear back from them, do not screw up the process while they are working on it.

I'm confused. My father would never sign the papers to sell his car, even though hes 92, so I've held off but have been encouraged by doctor, attorney and family to do so because we will run out of money if not. But Dads best wishes is ABSOLUTELY NOT! DO NOT sell my car. Those are his wishes...Should I or should I not? He will run out of money in 4 months..

If a person is not diagnosed as incompetent, you cannot sell any tangible assets without their permission, even if you have a POA. A POA is only for the purposes of making decisions when the principle is unable or cannot make decisions for themselves.

Why don't you rent the house if you can get enough to help pay her ALF?

Talk to an elder law attorney..... find out if you sell the house if the money can be put into a trust for his future care. If the trust is done properly it is not counted as income. If the home is rented he would have to declare that as income disqualifying his VA.
