Thanks for the answers. But, they just confused me, Let me be specific.

My wife is in a private pay Board and Care in California. Her only income is SS. WE file a joint return. We have Medicare and private medical insurance but not long term.

She is in Hospice because she has dementia & diabetes and is in decline (bed bound, incontinent, etc.). Is her rent paid for the Board & Care tax deductible?

WhatAbout, rules for IRS are in constant motion, plus State laws can change. What might have worked for last years taxes, may not work for this years taxes.

Therefore, it is highly recommended your speak with a Certified Public Account or a Tax preparer who can guide you with these questions.

I would put this answer to a certified CPA, accountant, tax preparer or other expert. Much depends on percentages, amounts applicable to care as opposed to rental and etc. This is a question for experts.

I know that renters do get a tax break but not sure if in this situation you would. You would need to determine how much of the monthly charge is actually for her room. That may be hard because in my Moms monthly room and board it included meals, laundry and housekeeping.

April is getting close. I hope you are not trying to do ur own taxes. I think you would be better off paying the money for a good tax prepayer, maybe one with a CPA.

Did u ask a question under a different name? If so, you can reply to the thread you ask ur question. No need to start another one. It gets confusing for us when there is more than one thread going. Just reply to this one now.

If the home isn't providing you with the information and you don't have a CPA or Elder Law Attorney, I would ask this question at www.bogleheads.org, an excellent financial advice forum.
