We need to get access to her meager bank acct to get $ below $2000 before deadline. With courts so slow, what happens if deadline is past? Can she have $1500 in there or does it have to go way low. We live in MA. Thanks so much!

$1500 is less than $2000.

Or do you mean she has $15k?

Can you ask your lawyer this question? Perhaps this needs to be changed to emergency guardianship.

Do you mean she is $1500 over the $2000? This is a question for the Medicaid caseworker if they are willing to let that go until u can get to the acct. Not something we as layman can answer. I had to prove by providing Moms Statement that she was under 2k before the 90 days allowed were over.

She already has pending status on Medicaid. Did the nursing home put that through? Or did you?
Because someone had to do the paperwork on that already. THAT person will know the rules for your state. Otherwise call the Medicaid offices for your own state (they are listed on Medicare site on computer if you search engine the .gov site). Each state varies. I think only 2,000 in assets is not going to be a problem. No one has POA I am assuming? Because prepaid funeral would wipe this out, this small account.

I recall your question to us as to whether payment of her storage locker would be OK. Was that made?
